Terms of Service

These terms set out the rules for using our website, free tools, community and services. Please read them — by using the site you agree to them.

These Terms of Service (“Terms”) are an agreement between you and GH Roworth Pty Ltd(ACN 658 761 105), trading as The Systems Coach(“we”, “us”, “our”). They govern your use of our website at thesystemscoach.com.au and the free tools, community, newsletter and information available on it.

Paid consulting, coaching, training and software engagements are also covered by a separate written agreement, quote or statement of work. Where that document conflicts with these Terms, that document applies to that engagement.

This is a working draft.We are finalising our terms and may update them — the “last updated” date above shows when they last changed.

1. Who we are

The Systems Coach is the consulting and software business of Greg Roworth. We provide Microsoft 365 modern-workplace consulting, SYSTEMology®-certified business-systems coaching, AI adoption training, and custom software and AI development, along with a free community, newsletter and online tools.

2. Acceptance of these terms

By accessing or using our website, submitting a form, using one of our free tools, or joining our community or newsletter, you agree to these Terms. If you do not agree, please do not use the site.

If you are using the site on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.

3. What we provide

Our website provides general business information, free interactive tools and calculators, a blog and newsletter, a free community, and details of our paid services. The content is provided for general information and to help you decide whether our services are right for you.

We may change, suspend or withdraw any part of the website, the free tools or the community at any time, without notice. We aim to keep the site available but do not guarantee uninterrupted access.

4. Free tools & calculators

Our website includes free interactive tools, calculators and assessments (for example readiness scorecards and business calculators). These are provided as a guide only.

  • The results, scores, estimates and recommendations they produce are indicative, based on the information you enter, and are not professional, financial, legal or tax advice.
  • You are responsible for the accuracy of the information you enter and for any decisions you make based on the output.
  • Some tools ask for your name and email before unlocking, and may record your inputs and results to our CRM so we can follow up. How we handle that information is set out in our Privacy Policy.

5. Community & newsletter

We offer a free community and a newsletter. When you join, you agree to receive related communications from us; you can unsubscribe from marketing email at any time using the link in any message.

Community membership is a privilege, not a right. We may decline, suspend or remove access where a member is abusive, breaches these Terms or the community guidelines, or behaves in a way that harms other members.

6. Paid services & engagements

Our paid consulting, coaching, training, membership and software services are described on the relevant pages of this site. The full scope, deliverables, timelines and price of any paid engagement are set out in a separate quote, proposal, statement of work or subscription agreement.

Booking a call, submitting an application or joining a waitlist is an expression of interest and does not by itself create a binding engagement. An engagement begins only when both parties agree to it in writing (which may include accepting an online checkout or subscription).

7. Fees & payment

Fees for paid services are as quoted or as shown at the point of purchase. Unless stated otherwise:

  • prices are in Australian dollars (AUD) and may be subject to GST;
  • subscription fees (for example membership) are billed in advance on a recurring basis until cancelled, and you can cancel future renewals at any time;
  • one-off and workshop fees are payable as set out in the relevant offer; and
  • payments are processed by our third-party payment provider — we do not store your card details.

Refunds, where offered, are described in the relevant offer or agreement. Nothing in these Terms limits rights you may have under the Australian Consumer Law.

8. Acceptable use

When using our website, tools or community, you agree not to:

  • use them for any unlawful, harmful or fraudulent purpose;
  • attempt to gain unauthorised access to any part of the site, its systems or another user’s account;
  • interfere with, disrupt or place an unreasonable load on the site or its infrastructure;
  • copy, scrape, resell or systematically extract our content or tools except as expressly permitted; or
  • upload or share content that is unlawful, infringing, misleading or offensive.

9. Intellectual property

Unless otherwise stated, we (or our licensors) own the intellectual property in the website and its content — including text, graphics, logos, tools, calculators and their underlying code. SYSTEMology® is a registered trade mark of its owner and is used under licence.

You may view and use the site and free tools for your own personal or internal business purposes. You may not reproduce, distribute, modify, or create derivative works from our content or tools for commercial purposes without our written permission. Where we provide templates or resources for you to use, we grant you a limited, non-exclusive licence to use them for that purpose.

10. Third-party services & links

Our website relies on third-party services (for example HubSpot for forms and bookings, and our payment provider) and may link to third-party websites. Those services and websites are governed by their own terms and privacy policies, and we are not responsible for their content, availability or practices.

11. Disclaimers

The website, its content and the free tools are provided “as is” and “as available”. To the extent permitted by law, we make no warranties that the site will be error-free, uninterrupted or secure, or that the information and tool outputs are accurate, complete or suitable for your circumstances.

Information on this site is general in nature and is not a substitute for professional advice tailored to your situation. You should obtain your own advice before acting on it.

12. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.

Subject to that, to the maximum extent permitted by law: we are not liable for any indirect, incidental or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of the website or free tools; and our total liability arising from your use of the free, public parts of the site is limited to AUD 100. Liability for paid services is governed by the agreement for that engagement.

13. Privacy

We handle personal information in line with our Privacy Policy, which forms part of these Terms. Please read it to understand what we collect and how we use it.

14. Changes to these terms

We may update these Terms from time to time as our services and the law change. The “last updated” date at the top shows when they last changed. Your continued use of the website after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Northern Territory, Australia. You and we submit to the non-exclusive jurisdiction of the courts of the Northern Territory and the Commonwealth of Australia.
